Preamble: Status and Collaboration with Nomadays
For your legal and financial peace of mind, Horseback Adventure has joined the network of local agencies Nomadays, its partner in France.
Nomadays is a tour operator approved in France, allowing you to benefit from all guarantees, insurance, and protections under French jurisdiction before, during, and after your stay.

This partnership has been established to guarantee, on one hand, the direct organization of your trip in complete freedom by Horseback Adventure, and on the other hand, to provide you with payment security and contractual protection as offered by any tourism business governed by French law.
As such, the quote is prepared by Horseback Adventure, as are the travel documents in your possession. The invoice, registration form, and online service payments are processed under the name of Nomadays, which is responsible for transferring the amounts due to Horseback Adventure.
Particular Conditions of Sale
These particular conditions of sale are intended to govern the relationship between Horseback Adventure, a company under Mongolian law registered under number 9019010034 (State number) and 5052475 (registry number), represented by Mr Sylvain RECOURAS-MASSAQUANT, with registered office at ULAANBAATAR (Mongolia), Chingeltei District, Khoroo 3, Bld 2 - 33 toot, 11000 (hereinafter "Horseback"), telephone number 11331098, email (hereinafter "the Local Agency"), and the Client (hereinafter "the Client").
The Client acknowledges having read these particular conditions of sale and the description of the chosen trip. Any purchase of a stay implies the full and unconditional acceptance of these particular conditions of sale.
I. Quote and Reservation
I.1. Quote and Types of Stay
The stays organized by the Local Agency may be of two main types:
- group stays with fixed dates
- private stays (bespoke or according to pre-established itineraries)
All of these products are referred to collectively as "stays" in these particular conditions of sale.
Prices are calculated according to the specific features of each stay, the activities, and services included. Prices shown on the Local Agency's website are indicative and may be subject to revision.
The final price is stated in the quote sent by the Local Agency. The quote may have an expiration date, beyond which the stated price is no longer guaranteed.
If the quote validity period is exceeded, the Local Agency may prepare a new quote at the Client's request.
I.2. Group Stays with Fixed Dates
Groups are formed by the Local Agency as reservations are received.
They consist of a minimum of three participants and a maximum of ten participants, unless otherwise noted on the website.
This maximum number cannot be exceeded without the agreement of all registered participants.
However, this maximum can be increased to eleven if the last reservation, when there are already nine registered participants, concerns two people traveling together, and this without notice to other already registered participants.
Departures are guaranteed with a minimum of three participants.
If only two participants are registered, the Local Agency undertakes to ensure the departure in exchange for payment of a supplement, the amount of which varies depending on the itinerary and is indicated on its website, on the page for each stay.
Prices for this type of stay are listed on the Local Agency's website on the page for each stay.
I.3. Private Stays
Clients wishing to travel exclusively with their friends or family and without other travelers can privatize a stay. Departure and return dates are freely determined, and the price depends on the number of participants. The various prices are indicated on the Local Agency's website on the page for each stay.
The private stay is flexible; services can be added or removed, and the itinerary can be modified. The price may then be adjusted according to the changes made. In this case, the Local Agency sends a personalized quote to the client.
The Local Agency undertakes not to add any additional participants to an exclusive group stay unless the group makes an express request to do so.
In case of cancellation by one or more members of the exclusive group, please refer to section 4.2.
I.4. Description of Itineraries and Services
The photos on the Local Agency's website are intended to illustrate the descriptions of landscapes you may see during your stay. They do not constitute contractual commitments by the Local Agency.
Travel times are given for information purposes only and do not constitute contractual commitments.
Some journeys may include encounters with the local population, or even stays with local families. The Local Agency undertakes to do its best to ensure that encounters take place under the best possible conditions, in particular, if the tour is guided, by working with guides who have good interpersonal skills and can facilitate exchanges between locals and clients, but does not guarantee the quality of each encounter from one family to another or from one day to the next.
Similarly, it should be noted that home stay services are not the same as those of a hotel. A family may have constraints (work, illness, etc.) that temporarily prevent them from welcoming clients under the best conditions.
I.5. Reservation Terms
Any registration request must be made by email to the Local Agency or directly online via the Client Area accessible from the Local Agency's website or from our network site www.nomadays.fr.
To access the Client Area, simply enter the username and password determined upon first login.
Registration is considered final once the online reservation form is completed and the deposit and/or balance payment is received, depending on the registration date. Depending on the services chosen and country regulations, a photocopy of your passport may be requested by the Local Agency. If the passport photocopy is not sent within the timeframe specified by the Local Agency, it cannot guarantee the proper execution of the reserved services.
Once payment is made, a confirmation email is sent to the Client. It includes payment confirmation and a downloadable electronic invoice.
A receipt acknowledgment is sent to the Client electronically. Should the Client not receive the receipt acknowledgment, the reservation is nonetheless final as of its receipt by the Local Agency.
II. Payment Terms
II.1. Payment Schedule
Registration made more than 30 days before the departure date
The Client must pay a 30% deposit of the total amount of reserved services. In case of booking an internal flight or other transport ticket, the Local Agency may also request full payment of said ticket to confirm its reservation. The balance of the stay must be paid no later than 30 days before the start date of the stay.
Registration made less than 30 days before the departure date
The Client must pay the entire amount of the trip in one installment.
In case of non-payment within the specified timeframe, the Local Agency reserves the right to cancel the services and apply the fees set out in article 4.2 below.
As part of the trip, the Client has the option to purchase travel insurance services. The insurance premium must be paid at registration.
II.2. Payment Methods
Payments are made:
- by credit card online, via payment links available on the electronic invoice
- by bank transfer to the Nomadays company account
The electronic invoice is updated with each payment received and remains viewable at any time from the Client Area. It is, among other things, downloadable and printable.
III. Preliminary Recommendations Before Your Stay
III.1. Administrative and Health Formalities
Before undertaking the trip, the Client is advised to ensure that they meet all administrative requirements regarding police, customs, and health regulations (valid passport, possession of required visas, any territory exit authorizations for minors, vaccination certificate, recommended vaccinations). It is strongly recommended to verify all information with the relevant authorities. Neither Nomadays nor the Local Agency can be held responsible in any way for the consequences of the Client's failure to comply with police, customs, or health regulations before and during the trip.
III.2. Information on Safety and Health Risks
The Local Agency recommends consulting the country sheet for your destination, published by the French Ministry of Foreign Affairs (MAE) on the website www.diplomatie.gouv.fr, under the "Travel Advice" section.
Please note that this information can change up to your departure date, so it is recommended to check it regularly. The Client is also invited to regularly consult information provided by competent authorities regarding health risks associated with the trip and to follow the recommended health measures to combat these risks, accessible on the websites www.sante.gouv.fr (French Ministry of Health and Sports) and www.who.int/fr (World Health Organization).
III.3. Physical and Mental Fitness
The Client must ensure that their physical condition is suitable for the intended trip. Difficulty and comfort levels are mentioned on the descriptive sheet and travel documents. It is important to be in good health, and it is recommended to consult a doctor. The Local Agency cannot be held responsible for insufficient physical fitness discovered during the trip.
IV. Modifications and Cancellations at the Client's Request
IV.1. Modification of Travel Services
Any modification of services occurring after signing the registration form may be considered as a cancellation by the Client, followed by a new registration. Consequently, the Local Agency reserves the right to charge the fees set out in article 4.2.
Nevertheless, the Local Agency will do its best to limit the cost of modifying services.
It should be noted that these possible fees are not reimbursable under the cancellation insurance purchased.
IV.2. Cancellation Conditions and Fees
Should the Client be obligated to cancel the trip, they must notify the Local Agency and their insurer by any written means that provides proof of receipt as soon as the event triggering cancellation occurs. The date of the written notification will be retained as the cancellation date for calculating cancellation fees. In general, the insurance company determines, based on documents provided by the Client directly, the date the triggering event occurred to decide whether to approve reimbursement of cancellation fees.
Complete Cancellation Fee Schedule:
- more than 45 days before the departure date: 30% of the total price including tax of the trip
- 44 to 31 days before the departure date: 50% of the total price including tax of the trip
- less than 30 days before the departure date: 100% of the total price including tax of the trip
Partial Cancellation Fee Schedule, except in special cases:
If a traveler registered for a private stay cancels their participation while the trip continues for other participants:
- for personal (non-shared) services: the complete cancellation fee schedule above will be applied to the traveler who cancels.
- for shared services: fees equal to 100%, regardless of the cancellation date, will be charged to the participant who cancels on their share of the shared services of the trip.
When multiple clients have registered for the same file and one of them cancels their trip, cancellation fees are deducted from the amounts collected for that file, regardless of who made the payment.
Special Cases:
- 100% cancellation fees may be applied from registration for certain hotels.
- 100% cancellation fees may be applied from registration for certain trip services (excursions, cooking classes, etc.). The mention "non-refundable service" will be specified on the trip quote, if applicable.
- 100% cancellation fees apply to all internal flights.
In case of cancellation, for any reason whatsoever, external costs incurred by the Client such as transportation costs to and from the trip departure location (plane, train, or bus tickets), visa application fees, travel documents, vaccination fees, cannot be reimbursed in any way.
The provisions in the complete cancellation fee schedule and partial cancellation fee schedule are cumulative with the provisions in the "Special Cases" section.
IV.3. Contract Assignment
In case of contract assignment, the Client must notify the Local Agency no later than 7 days before departure by email. This assignment is possible subject to availability of air transport and the assignee meeting the appropriate standards. It may incur additional costs (notably in case of modification of plane ticket and personalized services), which will be charged to the designated assignee. In any case, both the assignor and assignee are jointly liable for payment of the trip price and any additional fees.
IV.4. Program Modification During Trip at Client's Request
Any program modification requested by the Client can only be implemented after approval by the Local Agency. Additional fees incurred from this modification remain the responsibility of the Client and must be paid on site to the Local Agency.
IV.5. Trip Interruption
Any trip interrupted due to the Client (for health or other reasons) does not entitle the Client to any reimbursement of unconsumed services from the Local Agency. Additional fees incurred as a result will not be covered by the Local Agency.
V. Modifications and Cancellation by the Local Agency
V.1. Cancellation by the Local Agency
Events constituting force majeure (unforeseen and insurmountable incidents or events such as: wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.) may lead to cancellation of the reserved trip. In such cases, the Local Agency and/or Nomadays will send an information email to the client. The Client will then have the choice between reimbursement or rescheduling for the full amount paid toward another trip of their choice. However, the Client cannot claim any compensation payment from the Local Agency or Nomadays.
V.2. Trip Modification
Between the time of confirmation of registration and departure, program modifications (dates, times, itinerary, guides, accommodations, etc.) may occur due to organizational difficulties or safety concerns. In such cases, the Local Agency will immediately notify the Client of these modifications by email. If this modification affects an essential element, the Client will then have the option to either cancel the contract or accept the modification proposed by the Local Agency.
During the trip, program modifications (dates, times, itinerary, guides, accommodations, etc.) may occur due to organizational difficulties or safety concerns. In cases where replacement services can be offered by the Local Agency, any additional cost will be covered by the Local Agency. In the absence of replacement services, except in cases of force majeure, the Local Agency undertakes to reimburse the price difference between the planned services and those actually provided.
A day's program involving a domestic flight may be modified, even after the start of the stay, depending on the final flight schedule (delays or schedule changes possible). The Local Agency cannot be considered responsible for program modifications related to a domestic flight schedule change or delay.
V.3. Interventions by Guides
Group travel inevitably requires compromises to adapt to external circumstances, trip objectives, personalities, and each person's physical capabilities. In this context, the Local Agency's expedition leaders and/or local guides may need to make decisions in the group's best interest that may not necessarily meet the expectations of certain participants. The guides' good faith regarding such decisions will never be questioned, and the Client agrees not to seek the Local Agency's liability for decisions made by the guide in the group's best interest.
The Local Agency reserves the right to refuse to accept or not to maintain any person participating in a stay if that person's behavior or physical condition prevents the proper conduct of the stay or is harmful to the safety, enjoyment, or interests of other stay members. A person asked to leave a stay for the reasons mentioned above will be responsible for costs incurred from their departure from the excursion and return home, and the Local Agency will not consider any claims or compensation requests.
V.4. Trip Interruption
Any trip may be interrupted on the guide's decision for duly justified reasons (safety, health, etc.). In this case, unless the interruption is due to force majeure, the Local Agency undertakes to reimburse the price difference between the planned services and those actually provided.
VI. Air Transport
VI.1. Transport Services
The Local Agency does not arrange international flight sales. The Client is solely responsible for their own transport to the trip location. However, it is recommended to consult the European list of banned airlines on the website ec.europa.eu/transport/air-ban/list_en.htm before booking your tickets for the trip.
The Local Agency and Nomadays have also partnered with "La Bourse des vols" to assist participants in booking international flights. The Local Agency may then recommend the flight best suited to your stay. The flight should then be booked directly with La Bourse des vols, and the client will be subject to that company's terms and conditions of sale.
For greater flexibility, it is recommended to purchase flexible and/or refundable services and to allow sufficient transfer times between airports/stations.
In the event of force majeure, an unforeseen and insurmountable event by a third party external to the Local Agency, or an event caused by the Client, it is recommended to notify the Local Agency as soon as possible. Modifications to services and fees resulting from these events will remain the responsibility of the Client.
Internal flights may be included as part of the stay. The Local Agency will communicate to the Client upon registration the identity of the airline(s) likely to operate these internal flights.
In case of modification after registration, the Local Agency will communicate to the Client, as soon as it has knowledge before departure, any changes in the identity of the airline(s).
The Local Agency undertakes to ensure that all airlines used are approved by the competent administrative authorities.
VI.2. Transport Conditions
General and specific transport conditions of airlines are accessible via their websites. Under the Warsaw Convention, any airline may modify without notice, in particular flight schedules and/or routes as well as departure and arrival airports. Should the airline make modifications, particularly due to technical, weather, or political incidents beyond Nomadays' control, delays or cancellations or strikes external to the Local Agency, additional stopovers, aircraft changes, route changes, political or weather events, and the Client decides to forgo their trip, the cancellation fees referred to in article 4.2 above will be charged to them. The Local Agency will not reimburse costs (taxis, hotels, transport, meals, etc.), provided the Client is under the protection of the airline.
In case of transport delays or baggage loss, boarding refusal (overbooking), and/or flight cancellation by the airline, it is recommended that the Client, to assert their rights against the airline, keep all original documents (tickets, boarding passes, baggage vouchers, or others) and request written documentation from the airline in case of boarding refusal (overbooking) or flight cancellation.
The Client will send their complaint to the airline as soon as possible, given the tight deadlines, with copies of supporting documents, and will keep the originals.
VI.3. Modification of Transport Services
Any modification of name or surname after registration requiring repurchase of plane tickets will result in fees equal to the price of the new tickets.
The total price charged by the Local Agency may therefore be different from that shown on the quote, particularly due to airfare adjustments (fuel surcharge adjustment, seat repurchase, or transport class change).
In case of trip modification by the Client resulting in modifications to any internal flights, the fee amount will equal the price of the new tickets.
VI.4. Reconfirmation
Any reconfirmation of the return flight remains the Client's sole responsibility.
VII. Insurance
VII.1. Travel Insurance Contract
To participate in our trips, you must absolutely have assistance and repatriation coverage and foreign medical expense coverage.
The Local Agency and Nomadays offer the Client specific insurance formulas for the proposed trips. These have been developed with CHAPKA ASSURANCES and AXA ASSISTANCE and we encourage you to review the contract developed with our partner, and we strongly suggest you purchase coverage.

If you choose to purchase one of these formulas, the agreement detailing all coverage and claims procedures is available on the insurer's website. The Client is invited to read it carefully. It is your responsibility, before or during the trip, to personally contact the insurer to activate the insurance coverage. The participant must therefore keep this agreement with them throughout their trip.
VII.2. Claims Procedure and Processing

VII.2.2. Other Requests
In case of trip cancellation or any other incident covered by the travel insurance contract purchased (baggage loss, etc.), the Client is invited to file a claim online at the following address: https://www.chapkadirect.fr/sinistre
VIII. Minors
Registration requests involving minors must be signed by the father, mother, or legal guardian and include the mention "consent of father, mother, or guardian."
Minors not traveling with their parents or guardians must possess, depending on the destination and in addition to identity documents required for the trip, a valid authorization for departure from metropolitan France.
Finally, a phone number and address allowing the minor or responsible party to establish direct contact must be provided.
For minors traveling with one parent, guardian, or other adult, it is that person's responsibility to ensure they possess the necessary documents to allow the accompanying minor to depart the territory (national identity card or passport and, if applicable, authority to depart).
IX. Price Revision Terms
Prices stated in quotes are established based on, in particular, the following economic data:
- transportation and fuel costs,
- fees and taxes related to included services, such as landing taxes, boarding taxes, port and airport taxes,
- exchange rates included in price composition.
These economic data are considered as of the date of the brochure and/or quote preparation. In accordance with articles L 211-12, R.211-8, and R.211-9 of the tourism code, prices in the contract are subject to revision upward or downward to account for variations in transport costs (fuel/energy), fees, taxes, and exchange rates. The Client will be notified of any price increase for the total package no later than 20 days before departure. This increase will apply in full to the affected portion of the price. In the event of a price increase, previously registered clients will be notified by registered letter with acknowledgment of receipt.
For any increase exceeding 8%, the Client will receive on a durable medium details of the price variation, its impact on the package price, the choice available to them to accept or refuse within a reasonable timeframe, and the consequences of non-response.
X. Liability
The Local Agency cannot be held responsible for the consequences of the following events:

Loss or theft of plane tickets (airlines do not issue duplicates).

Failure to present or presentation of expired or insufficient validity identity and/or health documents (national identity card, passport, visas, vaccination certificate, etc.) or non-compliant with prescribed formalities, at police, customs, or check-in.

Failure to check in (including for boarding delays).

Unforeseen and insurmountable incidents or events by a third party external to the Local Agency such as: wars, political unrest, government orders, strikes external to the Local Agency, technical incidents external to the Local Agency, airspace congestion, weather conditions, delays (including delays in postal delivery services for transmission of travel documents), breakdowns, baggage loss or theft, or other belongings.
Any delays suffered, possible cancellations originating from the above cases, as well as resulting route modifications cannot result in any compensation of any kind, in particular due to modification of the originally planned program duration or delay in a connection. Any additional costs related to a disruption (tax, hotel, parking, etc.) will remain the Client's responsibility.

Quality of infrastructure, telecommunications equipment, medical evacuations that the Client will encounter throughout their stay.

Level of medical treatment and services found locally, possible absence of a doctor or any person with medical expertise, possible unavailability of certain medications.
The Local Agency reserves the right to modify planned dates, times, or itineraries where the Client's safety cannot be ensured.
XI. Data Protection
Information requests and registrations are processed electronically.
Certain information must necessarily be provided to the Local Agency upon registration and/or quote request. They are clearly marked with an asterisk. Without providing them, requests cannot be processed. Other requested information is optional. Nomadays and the Local Agency wish to inform the Client that to enable execution of the travel service order, the Client's data will be shared with the Local Agency's partners, suppliers of reserved services (hotels, carriers, etc.).
Furthermore, the Client's data may be used for commercial prospecting purposes through promotional or commercial offers from the Local Agency and the Nomadays network as provided by law.
During navigation on the Local Agency's website, temporary cookies are placed on the user's computer to allow them to consult and place orders on the site. To disable them, please consult information specific to the browser used. Disabling cookies may prevent website access.
In accordance with the French Data Protection Act (Loi Informatique et Libertés) of January 6, 1978, any website user has the right to access, object to, modify, correct, and delete personal data concerning them. These rights are exercised by postal mail addressed to:

XII. Complaints
As a consequence of our membership in the Nomadays network of local agencies, any complaint regarding your trip must be sent to the Nomadays Customer Service by any means providing proof of receipt, as soon as possible after your return, accompanied by all supporting documentation.
